IRCC Ends Flagpoling For International Students To Apply For PGWP

IRCC Minister Marc Miller announced today that international students are no longer eligible to apply for a post-graduation work permit (PGWP) at the border. This measure, effective immediately, aims to curb the practice of "flagpoling."

What is Flagpoling?

Flagpoling involves temporary residents of Canada briefly leaving and re-entering the country to receive same-day immigration services at the border. This tactic is often used to bypass the typical wait times for online work or study permit applications. According to the IRCC, flagpoling consumes significant resources, diverts officers from enforcement duties, causes travel delays, and disrupts the flow of goods. Between March 1, 2023, and February 29, 2024, nearly 25% of all foreign nationals who engaged in flagpoling at the border were PGWP applicants.

To encourage applicants to apply domestically rather than at the border, the Canadian government is implementing new policies. IRCC is working towards a more integrated and streamlined processing environment worldwide to expedite application processing while maintaining improvements in processing times. This amendment aims to enhance fairness among applicants and is part of the Government of Canada’s efforts to reduce flagpoling.

A study permit typically expires ninety days after the anticipated completion of an international student's program. Qualified graduating students can apply online for a PGWP before their study permit expires. This allows them to work full-time while awaiting work permit approval and to receive an automatic letter for employers. Once approved, the work permit is mailed to the applicant.

Immigration Services Accessed via Flagpoling Temporary residents in Canada often use flagpoling to access various immigration services more quickly. After being granted permanent status, they can complete a "soft landing" by crossing the border and returning to verify their permanent residency. They can also renew permits, obtain new work or study permits, and extend their temporary resident status.

What is a PGWP?

A Post-Graduation Work Permit (PGWP) allows international students who have graduated from a designated learning institution (DLI) in Canada to work in the country for a period equal to the length of their study program, up to a maximum of three years. This permit helps retain international students and provides them with valuable Canadian work experience, which can be beneficial for those seeking permanent residency.
